1. Acceptance of These Terms

These Terms of Service form a legal agreement between you and ABHutch Family, LLC, the company that operates HutchRoots. Your access to the website and your use of our research services are both subject to these terms.

We may revise these terms from time to time. When we make material changes, we will update the last updated date at the top of this page and highlight the change on our website. Your continued use of the website or the services after any revision means that you accept the revised terms.

If any provision of these terms is found to be unenforceable, that provision will be limited or removed to the minimum necessary, and the remaining provisions will continue in full force and effect.

2. Who We Are

HutchRoots is the family history and genealogy service offered by ABHutch Family, LLC, the developer and provider of the service. For the purposes of these terms, references to HutchRoots, to us, to our team, or to similar words mean ABHutch Family, LLC.

ABHutch Family, LLC is a family run practice. We provide hands on genealogy research, record retrieval, digitization and restoration, oral history support, and the preparation of lineage charts and heritage maps.

3. Eligibility to Use the Services

You must be at least eighteen years of age to request genealogy research services from us or to place an order for any paid deliverable. If you are under eighteen, a parent or legal guardian must submit the request on your behalf and must accept these terms.

By engaging our services, you confirm that you are authorised to request research into the people you ask us to investigate, or that the people concerned are deceased, or that you otherwise have a lawful basis to seek that information.

We will not knowingly undertake research into living individuals at the request of a third party when doing so would invade their privacy, and we may ask you to confirm your relationship to people central to a research request.

4. Nature of Genealogy Services

Genealogy research is a painstaking and document based activity. It involves searching historical records, reading handwritten documents, comparing evidence and drawing conclusions about how people are connected.

The services we provide include family tree research and building, archive and record retrieval, heirloom digitization and photo restoration, oral history interview support, and the preparation of heritage maps and lineage charts. Each project is different because every family tree is different.

We provide our services with reasonable skill and care. We will describe our methods honestly, and we will present our findings with clear sourcing so you can understand how each conclusion was reached. We make no promise that every research question can be answered, as explained in more detail later in these terms.

5. Proposals, Quotations and Scope

Before we begin research, we will discuss your goals, the names and facts you already hold, and what you hope to achieve. Following that conversation, we will prepare a written proposal that describes the work and its scope.

Each proposal will set out the specific records we plan to search, the geography and time period involved, the expected number of hours or the agreed project fee, and the deliverables you will receive. We treat the proposal as the definition of the work we have agreed to complete.

Should the research uncover an opportunity or a challenge that falls well outside the agreed scope, we will pause and inform you before continuing. This avoids surprise costs and keeps the project defined. You may always ask for the scope to be widened with an updated quotation.

6. Fees, Payment and Refunds

Fees for research are agreed in advance and stated in the proposal or quotation we send you before work begins. Unless otherwise agreed in writing, we will confirm project milestones and invoicing arrangements before we start.

Where we work on an hourly basis, we will track our time carefully and report the hours used so that you can see how the budget is being spent. Where we work for a fixed project fee, that fee is confirmed before work starts and will not change unless the scope changes.

You will receive your completed deliverables once the agreed fee has been settled, unless we have agreed a different payment schedule. If, for a genuine reason beyond our control, we cannot begin or complete the agreed work, we will refund any amount already paid for work not yet performed. We ask our clients to pay invoices within the payment terms shown on the invoice.

7. Your Obligations

To serve you well, we rely on you to share accurate starting information and to tell us honestly about what you already know and what you have tried.

You agree to provide us with the documents, family group sheets and details you have that are relevant to the project, and to let us know if any information we rely on changes during the engagement. You also agree to obtain permission from any living family members whose personal information you ask us to process.

You agree that you will not use our website or our services for any unlawful purpose, that you will not misrepresent the identity of any living person to us, and that you will not reproduce or resell our research outside the terms of the licence described in these terms.

8. No Guarantee of Research Outcomes

Family history research is founded on surviving records, and not every branch of every family has left a complete paper trail. There may be gaps in registers, destroyed court records, illegible handwriting or record series that simply do not survive.

Because of this, we cannot and do not guarantee that we will find the answer to every question, that every generation can be traced, or that we will reach any particular ancestor. We guarantee that we will search thoroughly, record our work honestly and report clearly on both what we found and what we could not find.

Where we state a connection or a lineage, we do so on the basis of our professional reading of the evidence and the sources we cite. A genealogy always remains open to being refined if new records surface later, and we will be glad to advise you if that happens.

9. Use of Records and Databases

In the course of research, we draw on publicly available records, subscription genealogy databases, libraries and archives. Where a record source requires a subscription that we do not already hold, we will tell you before we subscribe, because the cost of any new subscription may need to be treated as part of the project.

Record availability can change: a database may be indexed, a collection may go offline temporarily, or an archive may impose new access rules. We will adapt our research wherever possible and keep you informed of any material change to the sources we planned to use.

We do not share or republish the contents of commercial databases except as needed to report research to you within the terms of those databases, and we respect the licensing conditions of every source we consult.

10. Ownership of Research and Deliverables

Any lineage chart, heritage map, report, narrative, digitized copy or written summary that we create specifically for your project is delivered to you for your personal and family use once we have completed the engagement.

We grant you a personal, non exclusive, royalty free right to keep, display and share the deliverables within your own family and with your immediate research collaborators. You may archive them, reproduce them for family members and attach them to your personal family history records.

You may not claim these deliverables as your own original work, sell them to a third party, or incorporate them into a commercial product for resale without our prior written consent. Original source documents always remain the property of their rightful holders, and we do not convey any ownership over historical records themselves.

11. Confidentiality and Data Use

We treat the family history information you share with us as confidential to your project. Our handling of personal information is described fully in our Privacy Policy, which forms part of these terms.

We will not publish your family details on a shared tree, sell your data, or reuse your project material for another client without your clear permission. Where you ask us to add findings to a public family tree that you control, that is your choice and we will follow your instruction.

Both of us agree to keep the terms of any engagement, the underlying records, and the conclusions we reach within the circle of people properly involved in the project, respecting the privacy of living relatives throughout.

12. Intellectual Property Rights

The HutchRoots website and all of its content, including text, layout, graphics, hand drawn style elements and the overall design, are protected by copyright and other intellectual property laws. The website belongs to ABHutch Family, LLC.

You may view, save and print reasonable portions of the website for your personal, non commercial use, for example when you read our Privacy Policy or Terms of Service. You may not copy large parts of the website, use our design elements to build a competing service, or reproduce our written materials for commercial publication without permission.

Our name HutchRoots and our associated branding are used to identify our genealogy service. You may not register domain names, trademarks or service marks that are confusingly similar to ours, implying that you are us or that we endorse you.

13. Acceptable Use of the Website

You agree to use the HutchRoots website lawfully and respectfully. You must not attempt to gain unauthorised access to any part of the site, its servers, or the systems connected to it.

You must not overload the website, send automated queries that interfere with its normal operation, introduce software that could harm it, or use the site to collect information about other visitors in an abusive manner.

You must not use the website to transmit unlawful, harmful, defamatory or otherwise objectionable material, or to impersonate another person. We reserve the right to restrict access to the website if we reasonably believe these rules are being broken.

14. Disclaimers and Limitation of Liability

Our website is provided on an as available and as is basis. While we keep it accurate and current to the best of our ability, we do not warrant that the website will be uninterrupted, free from errors, or always available.

To the fullest extent permitted by law, ABHutch Family, LLC will not be liable for any indirect, incidental, special or consequential loss arising from your use of the website or from our research services, including loss of profits or expectations about what your family history might reveal.

Our total liability to you arising from a single engagement, whether in contract, tort or otherwise, will not exceed the total amount you paid to us for that specific project. Nothing in these terms seeks to limit liability that cannot lawfully be limited, such as liability for fraud or for personal injury caused by our negligence.

15. Third Party Services and Links

Our website may refer you to archives, databases, libraries and other genealogy resources operated by independent organisations. These links are provided to help your research.

We do not control third party websites and are not responsible for their content, their availability, or their handling of your information. Any arrangements you make with a third party resource are made directly between you and that resource.

We may also use a limited number of technical service providers to help deliver our website and communications. These providers act on our instruction, and their obligations follow the Privacy Policy described earlier.

16. Indemnity

To the extent permitted by law, you agree to hold harmless and indemnify ABHutch Family, LLC and its team members from and against any claims, losses or reasonable expenses that arise out of your misuse of the website or your breach of these terms.

This means that if your unlawful or improper actions cause a legal claim against us, you will be responsible for settling that claim and any reasonable costs we incur in defending ourselves.

This indemnity does not apply where a loss is caused by our own negligence or by our failure to meet our professional duties to you, and it does not affect any rights you hold that cannot be waived by law.

17. Suspension and Termination

We may suspend or restrict use of the website if we reasonably believe these terms are being broken or that the website is being used in a way that could cause harm.

You may end an engagement with us at any time by telling us in writing. If you do so, you will pay us for the work we have already completed and for any reasonable costs we have incurred on your behalf up to the date of termination.

We may end an engagement if you fail to meet your obligations, fail to pay an invoice within its agreed terms, or ask us to do something that would be unlawful or that would go against the professional limits described in these terms. In that event we will return any deliverables already paid for and settle any balance due for completed work.

18. Governing Law and Disputes

These Terms of Service, and any dispute arising out of your use of the website or our services, will be governed by and interpreted in accordance with the laws of the United States of America and the State of Utah, without regard to conflict of law principles that would apply another law.

Before initiating any formal proceedings, we invite you to raise any concern directly with us so that we can try to resolve it amicably. We are a small practice and we would always rather talk through a difficulty than enter a dispute.

Where a dispute cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the courts located in the State of Utah for any claims that are not otherwise resolved through our discussions.
